By accessing and using the AGIRE website (agire.ai) and services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. AGIRE operates from France and these terms are governed by French and European Union law.

Important - B2B Services Only: Our services are strictly intended for professionals and businesses (B2B). By using our services, you confirm that you are acting in your professional capacity and not as an individual consumer. The provisions of the French Consumer Code (Code de la consommation), including but not limited to the 14-day withdrawal right, do not apply to professional users of our services.

2. Description of Services

AGIRE provides technical content marketing services for B2B companies in the Water, Energy, and Waste sectors. Our services include:

  • LinkedIn strategy audits
  • Technical content creation and optimization
  • Lead generation strategy consulting
  • Access to our proprietary Caméléon platform

3. User Responsibilities

When using our services, you agree to:

  • Provide accurate and complete information
  • Maintain the confidentiality of any account credentials
  • Use our services only for lawful purposes
  • Not attempt to gain unauthorized access to our systems
  • Not use our services to distribute spam or malicious content

4. Intellectual Property

All content on this website, including text, graphics, logos, and software, is the property of AGIRE or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Content created through our services for clients becomes the property of the client upon full payment, unless otherwise specified in a separate agreement.

5. Free Audit Service

Our free LinkedIn strategy audit is provided as-is with no guarantees of specific outcomes. The audit is for informational purposes and does not constitute professional advice. We reserve the right to modify or discontinue this free service at any time.

6. Limitation of Liability

To the maximum extent permitted by law, AGIRE shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or data
  • Business interruption
  • Cost of substitute services

Our total liability shall not exceed the amount paid by you for our services in the twelve (12) months preceding the claim.

7. Disclaimer of Warranties

Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee specific results from using our services. Lead generation and business outcomes depend on many factors beyond our control.

8. Indemnification

You agree to indemnify and hold harmless AGIRE, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our services or violation of these terms.

9. Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without cause, and with or without notice. Upon termination, your right to use our services will immediately cease.

10. Modifications to Terms

We may modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the new terms.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with French law and European Union regulations, without regard to conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of France.

12. Dispute Resolution

Any disputes arising from these terms or your use of our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts in France. In accordance with EU regulations, you may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and AGIRE regarding the use of our services.
